These Terms govern the Courtily website, accounts, services, orders, payments, fulfillment, and related customer support.

These Terms do not require arbitration or waive participation in a class action.
Nothing in these Terms limits rights or remedies that applicable law does not allow Courtily to waive.

These Terms & Conditions are an agreement between you and Courtily LLC. They apply when you access courtily.com, create an account, submit information, request a service, or place an order. By doing so, you agree to these Terms and the policies linked from them.
You must be at least 18 years old and legally able to enter into this agreement. If you act for an organization, you represent that you are authorized to bind that organization.
You must provide accurate information, keep account credentials confidential, and promptly update information that changes. You are responsible for activity conducted through your account unless applicable law provides otherwise.
You agree that Courtily may send transactional communications electronically, including account verification, order documents, payment instructions, production updates, delivery notices, policy notices, and support responses. Marketing messages require separate consent.
Submitting an order is an offer to purchase. An automated acknowledgment does not require Courtily to accept an order. Courtily may reject or cancel an order before acceptance for availability, pricing or description errors, payment or fraud concerns, delivery limitations, legal restrictions, or inability to fulfill the confirmed plan. Any collected amount for a rejected order will be refunded.
Sample, Custom Design, and Product Orders cannot be combined in one checkout. Prices, coupon amounts, Design Credit, tax, shipping, and totals are recalculated by Courtily systems before an order is confirmed. Courtily may correct a genuine pricing or description error before accepting the affected order.
Sample products are priced at $0. The customer pays the displayed Sample shipping and applicable tax. Samples currently ship only to the contiguous 48 United States and Washington, DC. Alaska, Hawaii, and U.S. territories are not eligible.
Sample colors are selected from colors currently available for the related product and cannot be requested or guaranteed. A random color is not a wrong item. Samples are not returnable for preference changes. Wrong, missing, or delivery-damaged samples follow the Returns & Refunds Policy.
Custom Design is a digital service for one project per Design Order. The applicable fee is shown before payment and is calculated from the confirmed project type and area, subject to the published minimum. Custom Design Orders may use an eligible fixed-amount coupon and do not include shipping.
A Design Order may be canceled and refunded before it reaches In Progress. Once work begins or Courtily provides the first design deliverable, a change-of-mind refund is not available. A refunded Design Order voids its related Design Credit, subject to resolution of any linked Product Order.
Product Orders are made to order for the confirmed project and have a 10 sq ft minimum purchase area. Product Orders accept only ACH or wire transfer, require full payment, and do not accept credit cards. Payment is not confirmed until an authorized Courtily administrator verifies receipt of the correct funds.
A Product Order may be canceled before both payment confirmation and release to production. Once both events occur, the order enters its dedicated production schedule and becomes final sale for change-of-mind purposes. Verified fulfillment, product, warranty, or payment errors remain reviewable under the applicable policy.
The expected Product production period is approximately 60 days after payment is confirmed and the order is released to production. This estimate covers production only and is not a promised delivery date.
Displayed prices are in U.S. dollars unless stated otherwise. Applicable sales tax is calculated through the checkout or order workflow. Product shipping is $0 only within the delivery scope and conditions described in the Shipping & Delivery Policy.
Coupons provide a fixed-amount discount and may have eligibility, usage, or expiration limits. An eligible Design Credit equals the amount paid for the related Design Order, expires 180 days after issuance, may be used once, and applies to a Product Order only after an eligible coupon. A credit may be reserved while a Product Order awaits payment and becomes used only after payment is confirmed.
Product delivery is currently limited to carrier-accessible addresses in the contiguous 48 United States and Washington, DC. Standard transportation from the production facility in China, import duties, standard customs clearance, and curbside delivery to the confirmed address are included in the confirmed Product delivery plan.
The customer is responsible for accurate address information, lawful and safe site access, receiving availability, unloading, moving products after curbside delivery, storage, installation, permits, and any equipment or labor required at the destination. Address changes, failed or repeated delivery, waiting time, limited access, special equipment, or nonstandard service may require separately approved charges.
If Courtily cannot ship within the confirmed estimate, Courtily will provide an updated estimate and the legally required choice to accept the delay or cancel the unshipped order for a full refund. Additional terms appear in the Shipping & Delivery Policy.
Cancellation, correction, replacement, and refund eligibility depend on the order type and issue. Visible shortages, wrong products, and shipping damage must be reported in writing within 30 days after delivery. No physical item may be returned without Courtily's written instructions.
The Returns & Refunds Policy controls cancellation and refund handling. The applicable Limited Warranty controls verified product-defect claims. Those policies are incorporated into these Terms. They do not limit non-waivable rights under applicable law.
You retain ownership of plans, images, files, text, and other materials you submit. You grant Courtily a non-exclusive license to host, copy, review, adapt, and share those materials with service providers only as reasonably necessary to provide the requested service, prepare or fulfill an order, provide support, protect the service, or comply with law.
You represent that you have the rights and permissions needed to submit the materials and that Courtily's permitted use will not violate another person's rights. Do not submit unnecessary sensitive information.
The Courtily website, brand, text, graphics, software, product presentation, and other Courtily-provided content are owned by Courtily or its licensors and are protected by applicable law. Courtily grants you a limited, revocable, non-transferable right to use the website for personal or internal business evaluation and permitted transactions.
You may not copy, resell, publish, scrape, reverse engineer, remove notices from, or create derivative commercial uses of Courtily content except as allowed by law or written permission.
You may not misuse the website, attempt unauthorized access, interfere with security, introduce harmful code, use automated systems that unreasonably burden the service, impersonate another person, submit unlawful or infringing material, commit fraud, or use Courtily services in violation of law.
Courtily uses third-party providers for hosting, authentication, database, payments, tax, email, analytics, storage, and fulfillment support. Their systems may be subject to separate terms and privacy notices. Courtily remains responsible for its own promises but does not control an independent third party's systems or availability.
Except for an express written Limited Warranty or another written commitment that expressly applies, the website and general informational content are provided on an as-available basis. Courtily does not promise uninterrupted access, error-free operation, or that general planning information fits every site or project.
Courtily does not disclaim or limit any implied warranty, statutory guarantee, or other consumer right where applicable law prohibits that disclaimer or limitation. Product-specific written warranties and confirmed order documents control over general website information when they directly conflict.
To the maximum extent permitted by law, Courtily will not be liable for indirect, incidental, special, exemplary, or consequential damages arising from use of the website or an order. For a claim arising from a specific transaction, Courtily's aggregate liability will not exceed the amount paid for the affected product or service in that transaction. For a website-only claim not tied to a transaction, aggregate liability will not exceed $100.
These limits do not apply to fraud, willful misconduct, gross negligence, personal injury caused by Courtily where the limit is prohibited, breach of an obligation that cannot legally be limited, or rights and remedies that applicable law does not permit the parties to waive.
To the extent permitted by law, you will be responsible for third-party claims, losses, or reasonable costs caused by your unlawful misuse of the service, your material breach of these Terms, or materials you submit without required rights. This obligation does not apply to the extent a claim is caused by Courtily's own breach, negligence, or unlawful conduct.
Courtily may restrict or suspend access when reasonably necessary to protect accounts or systems, investigate suspected misuse or fraud, comply with law, or address a material breach. Termination does not erase payment obligations, completed transactions, accrued rights, or provisions that by their nature should survive.
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules. Subject to any mandatory consumer forum right, a dispute must be brought in the state courts located in Sheridan County, Wyoming, or the federal court with jurisdiction over Sheridan County. These Terms do not require arbitration and do not waive participation in a class action.
Courtily may update these Terms prospectively. The current version and Last updated date will appear on this page. Material changes will be communicated when required by law. Changes do not retroactively alter an accepted order unless the parties agree or applicable law requires otherwise.
